UPDATE: Superior Court Judge William C. Meehan will issue a ruling on whether a settlement reached between the borough and developer Landmark Dumont LLC in March is fair to low- and moderate-income households on May 26.
If he deems it fair, it will clear the path for Landmark Dumont LLC to build up to 142 rental units, including 18 affordable units, on the property of the former plant nursery.
Families Advocating a Reasonable Masterplan in Dumont (FARM'D) used the public comment portion of the hearing to oppose the settlement.
"We want to point out where we think this settlement is unfair not only to Dumont residents, but to low and moderate-income families," said FARM'D member Tom Kelly.
A city planner testified before Meehan on alleged flaws in the settlement, Kelly said, adding that nine other members of FARM'D also spoke.
The group presented Meehan with a petition signed by more than 1,240 residents opposing the deal.
"If we weren't there I think the judge would of ruled in favor of the developer today," said Rachel Brunin, another FARM'D member.
A few dozen members of FARM'D gathered outside the Bergen County Courthouse for a peaceful protest before the hearing.
